Birmingham EEOC Charge Representation
An EEOC matter begins with more than selecting a legal label. The charge, employment timeline, and filing requirements can affect which concerns receive investigation and what steps remain available afterward.
Aventus Law PLLC represents employees in Birmingham and throughout Alabama. Our office is at 324 Commons Drive, Suite 34, Birmingham, AL 35209. Call (205) 210-8533 for 24/7 intake.
Understand the process before choosing a step
The Equal Employment Opportunity Commission receives charges concerning discrimination and retaliation under the laws it enforces. For claims such as Title VII and ADA discrimination, an employee generally must file an appropriate charge before bringing a lawsuit. Other claims follow different requirements. Federal employees and applicants use a different complaint process.
An online inquiry, interview appointment, internal HR complaint, and signed charge are different steps. Do not assume that scheduling an interview or contacting a law firm has filed a charge. Ask what has actually been submitted and keep copies of the documents and confirmations.
Build a focused account
Prepare a chronology identifying the challenged employment decisions, when you learned of them, the people involved, and why you believe a protected characteristic or activity played a role. Include the employer’s explanation and records that support or complicate your concern.
Useful materials can include the termination notice, performance reviews, complaints, requests for accommodation, relevant messages, and names of witnesses. If you already filed, provide the charge, amendments, portal notices, employer submissions you received, and any agency decision.
A lawyer can help evaluate the appropriate claims, organize the account, and consider responses or settlement discussions within an agreed scope of representation. Hiring a lawyer does not guarantee an agency finding, settlement, or lawsuit.
Consider mediation and later decisions
EEOC mediation is a voluntary process in which a neutral mediator helps the parties explore resolution. Whether to participate depends on the circumstances and available information. An agreement can contain releases and other important terms that deserve careful review.
If investigation continues, respond promptly to requests and keep contact information current. Tell the firm about new discipline or other employment changes. A later event may require a separate timeliness and charge-scope analysis; it should not be assumed to be covered automatically.
Treat notices and deadlines seriously
EEOC filing periods are short and depend on the claim and circumstances. A notice of right to sue can trigger a separate court-filing deadline for Title VII or ADA claims. Read the notice when received and retain the envelope, email, or portal record showing receipt.
Do not request a right-to-sue notice merely to accelerate the process without understanding what follows. The decision can affect the investigation and the time available to prepare a lawsuit.
