Birmingham FMLA Leave Lawyer
A serious health condition or a family member’s medical needs can make time away from work necessary. If your employer denied leave, counted protected absences against you, or changed your job after you returned, the leave request and employment timeline deserve careful review.

Understand eligibility and protected leave
The Family and Medical Leave Act generally gives eligible employees of covered employers up to 12 workweeks of unpaid, job-protected leave during a 12-month period for qualifying reasons. These include an employee’s serious health condition, caring for a spouse, child, or parent with a serious health condition, and birth or placement of a child. Certain military-related needs also qualify, with additional leave available for qualifying military caregiving.
Eligibility generally requires at least 12 months with the employer, 1,250 hours of service during the preceding 12 months, and a worksite with at least 50 employees within 75 miles. Employer coverage is a separate question. Public agencies and schools have different coverage rules from private businesses, and some employees have special eligibility rules.
Leave may occur in separate periods or through a reduced schedule when medically necessary. Intermittent bonding leave generally requires employer agreement. Group health coverage generally continues on the same terms during protected leave, and paid leave may run concurrently under applicable rules. Return rights ordinarily include the same or an equivalent position, subject to legal exceptions.
Document requests and employer responses
For an initial request, you need not use the term FMLA, but you must provide enough information to alert the employer that the leave may qualify. Give notice promptly, follow applicable call-in procedures unless unusual circumstances prevent compliance, and respond to proper certification requests.
Save leave forms, medical certifications, attendance records, and relevant communications you lawfully possess. Note who received your request, what the employer required, and whether its explanation changed. We examine possible interference with leave rights separately from retaliation for requesting or using protected leave. Timing matters, but the surrounding evidence and employer’s explanation matter as well.
Tell us whether you remain employed, have received a return-to-work request, or face an attendance warning. That context helps us identify immediate decisions, missing records, and the questions to address with your employer.
Review your options promptly
FMLA lawsuits generally must be filed within two years of the last alleged violation, or three years for a willful violation. Other claims may carry shorter deadlines. Available enforcement routes and remedies depend on your employer and circumstances.
